1. The Promoter

1.2 Your data is held by: WebFife.com with all database, information & details, design, credentials, domain name and web hosting is leased from WebFife for use on Creed Competitions’s promoter services.
1.3 The name and logo of “Creed Competitions” is a registered UK trademark held by WebFife.

2. The Competition
2.1 These terms and conditions apply to all competitions listed on the Promoter’s website at creedcompetitions.co.uk (the “Website”)
2.2 All competitions are skill-based competitions and an entry fee is payable each time you enter.
2.3 To be in with a chance of winning, everyone who enters the competition (an “Entrant”) will be required to select and enter a competition created by the Promoter (the “Competition”).

3. Qualifying Persons

3.1 Creed Competitions LTD (‘Promoter’, ‘our(s)’) operate various skill-based competitions (‘Competition’ or ‘competitions’) resulting in the allocation of prizes (‘prize’or’prizes) in accordance with these terms and conditions on the website www.creedcompetitions.co.uk (‘the website’).

3.2 The Competitions are open to all persons aged 18 and over and reside in the United Kingdom except the Promoters employees / relatives.

3.3 The promoter reserves the right to close a customer’s account at any time, if they have reason to believe that the customer is abusing the services, being abusive to other customers or staff or if they have reason or evidence that the customer is using fake credentials.

3.4 The promoter reserves the right to refuse a customer’s entry at their own discretion.

4. Legal Undertaking

4.1 By entering a Competition, you confirm and agree that you have legal capacity to do so, you agree to have read and understood these terms and conditions and you will be bound by them and by any other requirements set out in any related promotional material.

5. Competition Entry

5.1 The competition will run from and including the opening and closing dates specified on the Website. These dates shall be referred to as the “Opening Date” and “Closing Date” respectively. All times and dates referred to are the times and dates in London, England.

5.2 All competition entries must be received by the Promoter by no later than the specified time on the Closing Date. All competition entries received after the specified time on the Closing Date are automatically disqualified and no refunds will be given.

5.3 All entries must be submitted in the English language. Entries in languages other than English will automatically be disqualified and no refund will be given.

5.4 The Promoter will not accept responsibility for competition entries that are not successfully completed, are lost or are delayed regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

5.5 By purchasing entries and submitting a competition entry, you are entering into a contract with the Promoter and are agreeing to be bound by these terms and conditions.

5.6 Competitions may be entered via the Website. The Promoter may run multiple competitions at the same time and each Competition will have a specific prize.

5.7 Availability and pricing of Competitions is dependent on the decision of the Promoter, the price will be specified at the point of sale on the Website. There is no obligation to pay for an entry to any Competition as every Competition has a free entry route available. See below for further details on how to enter a Competition for free. Having the availability of the free entry route to enter each Competition means that the Competition does not fall within the definition of a lottery under the Gambling Act 2005 and can be legally operated in Great Britain without the need for a licence.

5.8 In order to be eligible for a competition, you will be asked to register an account with us (even if entering for free). You can register an account online at www.creedcompetitions.co.uk

5.9 To register an account you will need to provide a valid email address.

5.10 When playing a Competition online via the Website, follow the on-screen instructions to: (a) select the Competition you wish to enter, when you are ready to purchase your entrie(s), provide your contact and payment details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition terms and conditions; (b) once you have purchased your entries, when your payment has cleared we will then contact you by email to confirm your entry into the Competition.

Please note that when entering online and/or by post you will not be deemed entered into the Competition until we confirm your entrie(s) order back to you by email.

6. Free Entry Route

6.1 Availability and pricing of Competitions is at the discretion on the Promoter and will be specified at the point of sale on the Website. There is no requirement to pay to enter any competition, as each competition has a free entry route available. To enter any competition via this route the Entrant must firstly create a free account via our website, as such postal entries cannot be processed prior to registration. The entrant must then send a postcard / enclosed letter stating which competition they would like to enter, acceptance of our terms and conditions and the following details: Name, Date of Birth, Home Address, contact number and Email Address (same information used to create a free account on our website) In order for free entries to be processed, Entrants must add their own billing address details to their accounts. All free entries must be posted to: Creed Competitions, Office 2 Fric, Ajax Way, Methil, Fife, Scotland, KY8 3RS and must arrive before the competition closing date. Postage must be paid by the entrant. Postal entries are limited to one entry per postcard / enclosed letter.  You will not be notified to confirm your free postal entry has been received until the Competition has closed and the entry list completed. Although multiple entries are acceptable, they must be sent individually, Any single postcard / single enclosed letter featuring multiple entries will be disqualified as being in breach of these Terms and Conditions.

6.2 The promoter reserves the right to refuse an entry or disqualify any incomplete entries if it has reasonable grounds for believing an entrant has contravened any of these terms and conditions. All free entries are treated in the same manner as paid entries. Where applicable these terms and conditions will also apply to free entries, all free entries will be processed upon arrival, Requests for free entries where the competition has already sold out will not be processed.

7. Your Account

7.1 The competition is only open to all residents in the United Kingdom (excluding Northern Ireland) aged 18 years or over, except:
(a) employees of the Promoter;
(b) employees and close relative of the Promoter, who are professionally connected with the competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.

7.2 By entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition. If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the competition.

7.3 The Promoter will not accept competition entries that are:
(a) automatically generated by computer; or
(b) incomplete.

7.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

7.5 No refunds of the entry fee will be given in any event, including;
(a) if, following your entry into the competition, you subsequently find out that you are not eligible to enter the competition or claim the Prize;
(b) if, following your entry into the competition the eligibility criteria for entering the competition or claiming the Prize changes and you are no longer eligible; or
(c) if you are disqualified from the competition by the Promoter for any reason.

7.6 It is your sole responsibility to keep your account password secure and safe at all times. You must try memorising your password, don’t share or tell anyone your password, never write down your password, never store your password on your phone or computer devices or record it in any way/ any place that someone can understand what it is. You should try and make a password for your account that is not easy for anyone to guess, try avoiding using names or dates of birth. It is your sole responsibility to ensure your account has been logged out once you are finished entering a competition to prevent someone using your account.

7.7 The Promoters advise you keep your log in username and password to yourself and tell no one, nor friend/family your log in details, to prevent access. You must use a password that is memorable and unique to yourself.

7.8 You must contact the Promoters at Creed Competitions if you suspect/ believe or are certain that someone other than you has/ had access to your account without your permission, or if you suspect/ believe that anyone other than yourself knows or may know your password.

7.9 The Promoters shall not be responsible and/or liable for any/and or all consequences arising out of and/or relating to any breaches of these rules.

7.10 If you forget your log in username and/or password you can reset these by following our reset details link on our website. You will be asked to provide relevant security information requested by the Providers to reset this and ensure it is you.

8. Promotion Periods

8.1 Each Competition will run its own promotions for a specified period. Please see each competition for their own details of starting and ending dates. For more information regarding the promotion period, you can contact Email: creedcompetitions@gmail.com

9. Competition Judgement

9.1 Our first ball spinning machine will determine the winner of each competition by releasing a numbered ball. The numbered ball will align with a random customer’s entry number. However, many entrants have entered the competition will determine how many balls will be entered into the machine. With a minimum of 1 balls and a maximum of 40 balls, max combination 9999. This will be live streamed on our Facebook page.

9.2 Our second random ball spinning machine will determine the winner of each competition which includes the alphabet by releasing a lettered ball. The lettered ball will align with a random customer’s entry letter. However, many entrants have entered the competition will determine how many balls will be entered into the random ball spinning machine. With a minimum of 1 balls and a maximum of 26 balls. This will be live streamed on our Facebook page.

9.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners on the Website
9.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at creedcompetitions@gmail.com prior to the Closing Date. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority on request.

9.3 After the Winner has been decided, the Promoter will attempt to contact the Winner(s) via the telephone, email address or social media that was provided by the Entrant at the time of registration (or as subsequently updated. It is the Entrant’s sole responsibility to check and update these details. If for any reason they are taken down incorrectly, the Promoter will not be held responsible. Entrants should carefully check their contact details have been recorded correctly at the time of registration.

9.4 If for any reason the Promoter is unable to contact the Winner within 30 days (which may be extended at the sole discretion of the Promoter) of the end of a Competition or the Winner fails to confirm acceptance of the prize or the Winner is disqualified there will be a re-draw minus the previously disqualified entry.

9.5 In the event that the Promoter closes a Competition early, the Winner will be selected from all valid and eligible Entries received by the Promoter prior to the date of closure.

9.6 The Promoter reserves the right, to close a Competition early without selecting a Winner. In the event that a Competition is closed without selecting a Winner, the Promoter will give all entrants credit to enable them to replay equivalent entries in a subsequent competition.

9.7 All Entrants are automatically entered onto the Promoter’s database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by the Promoter.
9.8 If the Number of Entries to the Competition does not meet the maximum number of entries at the closing date, the draw will still go ahead regardless and the prize will be offered.

10. Winner’s Details

10.1 Proof of identification will be required by the First Prize Winner upon delivery of the prize. Should this requirement not be met, the Promoter has the right to disqualify the Winner. In such cases, the prize will be in the possession of the Promoter.

10.2 Upon fulfilling the above-stated requirements the Winners will be contacted in order to make arrangements for the prize.

11. Competition Prizes

11.1 Limitation of liability Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

11.2 Our competition prizes are selected by the managing directors of the company and are owned by the promoter from the date of the competition going live on the website to the date that the winner receives the prize.

11.3 Details of each prize can be found on the website on the competition’s pages. We take no responsibility for the prize awarded after delivery, once the winner receives the prize the promoter does not insure the prize. No insurance comes with the prizes and the promoter cannot be held responsible for the prize once handed over to the winner.

11.4 Delivery of the prize is free of charge. Should the winner request the prize to be delivered to a different address from the one stated when they applied then the Promoter has the right to charge a delivery fee. Prizes can only be delivered to addresses within the United Kingdom.

11.5 All entrant expenses are the sole responsibility of the Winner(s).

11.6 The winner hereby agrees that all prizes are subject to and are conditional on the terms and conditions of the Promoter, Prize provider, manufacturer and/or supplier and/or anyone that is involved in the provision or delivery of the Prize to the Winner.

11.7 Each Prize must be accepted as awarded and is non-transferable or convertible to other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation any vouchers or offers of the Promoter or other prize suppliers.

11.8 After notifying the Winner(s), the Promoter can store the prize free of charge for up to 30 days. If the Promoter needs to store the prize for longer than 30 days then a fee will be applied and must be paid before the prize is received.

12. Electronic Communications

12.1 By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition or as otherwise set out in the Promoter’s Privacy Policy https://creedcompetitions.co.uk/privacy-policy/, a copy of which is available on the Website.

12.2 If you are the winner of the competition, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this competition. You further agree to participate in any reasonable publicity required by the Promoter.

12.3 If you do not wish to participate in any publicity, you must notify the Promoter prior to the Closing Date. This will not affect your chances of winning the Prize. If you do not agree to participate in any publicity about the competition we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with to prove that the competition has been properly administered and the Prize awarded.

12.4 If you are the winner of the competition, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the competition and forfeit the Prize. You will not be entitled to any refund of your entry fee. The Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.

12.5 Please note that under data protection laws you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request you will be withdrawing from the competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the competition. If you do not wish any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at creedcompetitions@gmail.com prior to the Closing Data.

12.1 For any failure of electronic communication due to partial or garbled computer transmissions, computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes, the Promoter nor We will hold no responsibility.

12.2 The Promoter will to its best endeavours award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.

12.3 The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the entry recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other events.

13. General

13.1 The Promoter reserves the right to amend these terms and conditions from time to time. The latest version of these terms and conditions will be available on the Website.

13.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition and any future competitions.

13.3 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

13.4 The competitions on the Website are in no way sponsored, endorsed, administered by or associated with Facebook. By entering the competitions, Entrants agree that Facebook has no liability and is not responsible for the administration or promotion of the competitions.

13.5 These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England.

13.6 You should print a copy of these terms and conditions and keep them for your records.

14. Data Protection Notice

14.3 Any personal data that you provide to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable. In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you; (iii) any person to whom the Promoter proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

14.2 By agreeing to these terms and conditions you authorise us to process and store your personal data and to transfer it to the Promoters, in order for us and them to be able to offer you the service we have agreed upon.

14.3 We will take all necessary technical and organisational measures to protect your personal data, however, due to the nature of data protection, we cannot guarantee the security of your information. In case of a data breach, we will notify you immediately and take all possible measures to protect your data.

15. Limitation of Liability

15.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.

16. Severability

16.1 If any provision of these Terms is deemed to be illegal or unenforceable by a court of competent jurisdiction, the enforceability or effectiveness of the remainder of these Terms will not be affected, and these Terms will be enforceable without reference to the unenforceable provision.

15. Amendments and No Waiver

15.1 These Terms may not be modified, amended or supplemented except by a separate written document executed by both parties. No term and conditions of these Terms shall be deemed waived and no breach or default excused unless such waiver or excuse shall be in writing and signed by the party issuing the same.

16. Force Majeure

16.1 We shall not be deemed to be in default of any provision hereof or be liable for any delay, failure in performance, or interruption of service resulting directly or indirectly from acts of God, civil or military authority, civil disturbance, war, terrorism, strikes, fires, other catastrophes, power or telecommunications failure or any other cause beyond its reasonable control.

17. Changes

17.1 The Promoters may revise and/or change some terms and conditions from time to time, the most current version of terms and conditions will be on the Website at all times. Please check this page regularly to ensure you are up to date with these terms and conditions to ensure you have a clear understanding. By continuing to access and use the website after these changes have been made, you therefore agree to be bound by the revised terms and conditions. We may also change/update the Website page from time to time and reflect changes to our offers.

18. Governing Law

18.1 These Terms will be governed by and interpreted in accordance with the internal laws of England and you submit to the non-exclusive jurisdiction of the state and national courts located in England for the resolution of any disputes that may arise.
